These Terms and Conditions ("Terms") govern your use of the AquaInsight mobile application ("the App") operated by Aetheric GmbH ("we", "us", "our"), a company registered in Switzerland. By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
The English version of these Terms is the sole legally binding version. Translations into other languages are provided for convenience only.
1. Description of Service
AquaInsight is an AI-powered mobile application that analyses photographs of freshwater aquariums to provide health scores, recommendations, and product suggestions. The App uses AI technology provided by Anthropic, PBC to generate analysis results. AquaInsight offers both a free tier and a Premium subscription.
2. Important Disclaimer
AquaInsight is an informational tool only. The analysis, scores, and recommendations provided do not constitute professional veterinary, aquaculture, or scientific advice. AI analysis may be inaccurate, incomplete, or misleading.
Aetheric GmbH accepts no responsibility or liability for the health, condition, injury, disease, or death of any fish, plants, invertebrates, or other aquatic life as a result of actions taken based on information provided by this App. Always consult a qualified aquarium professional or veterinarian for serious concerns.
By using AquaInsight, you acknowledge that you use this application entirely at your own risk.
3. Eligibility
You must be at least 13 years of age (or 16 in EU/EEA countries) to use the App. By using the App, you confirm that you meet this requirement.
4. Free Tier and Premium
The free tier includes a limited number of scans and management of a single aquarium. Premium unlocks unlimited scans and multi-aquarium management. Premium is available as an in-app purchase and is subject to the payment terms of the Apple App Store or Google Play Store.
All purchases are final. Refunds are handled in accordance with Apple App Store or Google Play Store refund policies.
5. Affiliate Links
AquaInsight may display links to products on Amazon and other third-party retailers. These may be affiliate links, meaning we earn a small commission if you click the link and make a qualifying purchase, at no extra cost to you. We are not responsible for the content, availability, pricing, or quality of products on third-party platforms. Any purchase is a transaction solely between you and the retailer.
6. Intellectual Property
All content within the App — including but not limited to text, graphics, logos, icons, and software — is the property of Aetheric GmbH or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
7. User Conduct
You agree not to use the App to upload unlawful, harmful, or misleading content; to attempt to reverse engineer, decompile, or extract the App's source code; to interfere with or disrupt the App's servers or networks; or to use the App for any commercial purpose without our written consent.
8. Third-Party Services
The App integrates with third-party services including Anthropic's AI API. Your use of these services is subject to their respective terms and privacy policies. We may include links to third-party websites. We do not endorse and are not responsible for any third-party content or practices.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Aetheric GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of revenue, harm to aquatic life, or any other damages arising from your use of or inability to use the App.
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid for Premium in the 12 months preceding the claim, or CHF 100, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless Aetheric GmbH and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
11. Modifications to the App and Terms
We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice. We may also update these Terms from time to time. Continued use of the App after any modification constitutes your acceptance of the new Terms. We will notify you of material changes via a notice in the App.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Switzerland, without regard to its conflict of law provisions. We prefer to resolve disputes informally — if you have a complaint, please use our Contact page and we will make reasonable efforts to resolve it.
If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland, unless mandatory consumer protection laws in your country of residence provide otherwise.
